Terms of Service

1. Introduction
Welcome to TapIn. These Terms of Service (“Terms”) govern your access to and use of TapIn's patient check-in notification platform, including our mobile applications, web dashboard, kiosk interface, and related services (collectively, the “Service”). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.
The Service is operated by TapIn (“Company,” “we,” “us,” or “our”). These Terms, together with our Privacy Policy, form a legally binding agreement between you and the Company.
2. Definitions
- “Organization” refers to a therapy practice, healthcare provider, or business entity that subscribes to TapIn.
- “Administrator” refers to an individual authorized to manage an Organization's TapIn account.
- “Therapist” refers to a healthcare provider using the TapIn mobile application to receive patient notifications.
- “Patient” refers to an individual using the kiosk interface to check in for appointments.
- “Kiosk” refers to the tablet-based check-in interface used by Patients.
- “User” refers to any individual using the Service, including Administrators, Therapists, and Patients.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes. This license does not include the right to:
- Copy, modify, or distribute the Service or any portion thereof
- Reverse engineer, decompile, or disassemble the Service
- Sublicense, lease, rent, or transfer your rights to the Service
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Access the Service through automated means, including bots, scrapers, or similar technologies
4. Account Registration
To use certain features of the Service, you must register for an account. You may register using Apple Sign-In, Google Sign-In, or email and password. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Promptly update your account information if it changes
- Accept responsibility for all activities that occur under your account
- Notify us immediately of any unauthorized access or security breach
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
5. User Qualifications
By using the Service, you represent and warrant that:
- You are at least 18 years of age (or the age of majority in your jurisdiction)
- If you are a Therapist, you hold valid professional licenses required to practice in your jurisdiction
- If you are an Administrator, you are authorized to bind your Organization to these Terms
- You will comply with all applicable federal, state, and local laws and regulations
- If you are a healthcare provider, you are responsible for compliance with HIPAA and other applicable healthcare regulations
6. Subscription and Payment
Access to certain features of the Service requires a paid subscription. By subscribing, you agree to:
- Pay all applicable fees as described at the time of purchase
- Authorize us (through our payment processors) to charge your payment method on a recurring basis
- Provide accurate and complete billing information
- Update your payment information promptly if it changes
Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your account settings or by contacting support. Cancellation will take effect at the end of the current billing period.
We process payments through Stripe. Your use of payment services is subject to their respective terms and conditions.
7. Free Trial
We may offer a free trial period for new subscribers. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. You may be required to provide payment information to start a free trial.
8. Refunds
Subscription fees are generally non-refundable. However, we may provide refunds at our sole discretion. Please contact us if you have any questions about refunds.
9. Healthcare Disclaimer
THE SERVICE IS NOT INTENDED FOR MEDICAL EMERGENCIES. IF YOU EXPERIENCE A MEDICAL EMERGENCY, CALL 911 OR YOUR LOCAL EMERGENCY SERVICES IMMEDIATELY.
TapIn is a patient check-in and notification tool. The Service does not provide medical advice, diagnosis, or treatment. Any healthcare services are provided by the Therapists and healthcare providers within your Organization, not by TapIn. We are not responsible for any healthcare decisions or outcomes resulting from the use of the Service.
10. Patient Data
TapIn is designed with privacy as a priority. The Service collects only the patient's name at check-in for the sole purpose of notifying the therapist of their arrival. We do not collect, store, or process any health information, medical records, diagnoses, treatment details, or other Protected Health Information (PHI).
All check-in data, including patient names, is automatically deleted according to your Organization's configured retention period. The healthcare relationship and all clinical information remain solely between the patient and their healthcare provider.
11. Data Retention
Check-in data is retained according to your Organization's configured retention settings. By default, check-in records are automatically deleted after 24 hours. Organizations may configure longer retention periods based on their compliance and business needs.
Upon termination of your account, we will retain or delete your data in accordance with our data retention policies and applicable law. You may request export of your data prior to account termination.
12. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on the rights of others, including privacy and intellectual property rights
- Transmit any malicious code, viruses, or harmful content
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Collect or harvest user data without authorization
- Use the Service for any fraudulent or deceptive purpose
- Impersonate any person or entity
13. Intellectual Property
The Service, including all content, features, and functionality, is owned by TapIn and is protected by copyright, trademark, and other intellectual property laws. The Service is licensed, not sold. Nothing in these Terms grants you any right to use our trademarks, logos, or branding without our prior written consent.
You retain ownership of any content you upload to the Service (such as organization logos). By uploading content, you grant us a license to use, store, and display that content as necessary to provide the Service.
14. Third-Party Services
The Service integrates with third-party services including Apple Sign-In, Google Sign-In, Stripe, Apple Push Notification Service, Firebase Cloud Messaging, and others. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.
15. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
16. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TAPIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) FIVE HUNDRED DOLLARS ($500).
17. Indemnification
You agree to indemnify, defend, and hold harmless TapIn and its officers, directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Any healthcare services provided by you or your Organization
- Your failure to comply with applicable laws or regulations, including HIPAA
18. Termination
We may suspend or terminate your access to the Service at any time for any reason, including if we reasonably believe you have violated these Terms. You may terminate your account at any time by contacting support or through your account settings.
Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination will survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.
19. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and/or sending you an email notification. Your continued use of the Service after such changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service.
20. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
21. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and TapIn regarding the Service.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
- Independent Contractors: The relationship between you and TapIn is that of independent contractors. Nothing in these Terms creates a partnership, joint venture, or employment relationship.
